Refunds & Exchanges Policy by Blake Ferguson Photography.

The Company caters and distributes high-class fine art pieces, but first and foremost, customer satisfaction. Understanding the nature of exclusive and limited printed products, Blake Ferguson Photography only wants to see you with your investment in safe measures and with the purpose intended. Refunds, exchanges, or other forms of compensation are considered at the Company discretion but are not guaranteed.

1. Order Cancellations

Given the nature of made-to-order, physical fine-art products- all transactions are final. The Company (Blake Ferguson Photography) cannot fully guarantee that the production process might have begun shortly after receiving your order and its payment. Review your order details concisely before and after placing your order, as the Company cannot guarantee that your order can be subject to cancellation.

 

If the production process has not begun within 48 hours and a cancellation is requested, cancellation requests will be permitted. If the production process has already started- as specified by third-party manufacturers, cancellation requests will not be eligible for compensation.

 

The Client is responsible for deciding upon a cancellation request within 48 hours- if not otherwise, revoking their opportunity to opt out of said purchase. 

 

Where cancelling an order may be possible, fees are refunded to the original payment method supplied by the Client in full, subtracting any merchant or transactional fees the Company fronts due to said purchase.

 

Digital Downloads and Educational components are supplied instantly after purchase, where orders of this nature prohibit cancellations, returns or refunds.

 

2. Returns, Refunds & Exchanges 

The Company reserves the right to refuse any request for exchange unless the Client has received the wrong item. In the event of receiving an item in error, Contact the Company within 30 days after the official date of your delivery, and the Company will compensate accordingly upon the Client successfully returning the original product.

 

Upon encountering damage- the Client is to provide photographs of the damage while Contacting the Company to address these concerns. Exchanges are not applicable after 30 days from the date of postal order processing.

 

Refunds will only be applicable in cases where a replacement is not possible due to product unavailability, manufacturing defects, or based on exclusivity concluded by the discretion of the Company. Refunds or replacements are determined based on the availability of the original medium. If a replacement is not feasible, a refund may be applicable at the discretion of the Company.

 

For exchanges, the Client is responsible for return shipping costs. Once the returned item is received and approved, the Company will reimburse the original shipping costs, resulting in a refund to the original payment method used by the Client. However, if the returned item proposes damage due to improper packaging, the Company reserves the right to refuse an adequate refund or exchange.

 

Force Majeure

The Company is not responsible for delays or non-fulfillment caused by circumstances beyond our control, including but not limited to natural disasters, supply chain disruptions, postal service delays, acts of government, or unforeseen technical issues. Among any Service disruptions regarding your order, the Company will always notify the Client when events occur.

 

The Company reviews return requests within five business days after receiving the returned item. Once approved, the Client will receive an alert regarding the outcome of their dispute, provided it is in its original condition, where a refund will be granted and processed within 3-7 business days from the date the dispute was approved, depending on their payment gateway and provider.

As the Company presumes compensation through channels of refund from designated shipping charges corresponding to the order placed by the Client, the Company presumes rights to ensure authentic processing and safe keeping of fine-art products and their nature. 

 

3. Digital Downloads

The Company reserves the right to refuse any refunds, exchanges or cancellation requests due to the nature of immediate delivery for Digitally Downloadable items.

 

All sales of digital downloads are final. Once a file is delivered, it cannot be returned, refunded or exchanged, even if the Client has not yet downloaded the applicable files.

 

Upon the succession of digital payment for Digitally Downloadable items, the Client assumes all responsibilities for the materials received from the Company. The files are delivered instantly to the email indicated by the Client, and where upon delivery, no refunds or exchanges are applicable due to the instant access of Digitally Downloadable items. Unauthorized sharing, reproduction, or distribution of digital products is strictly prohibited and may result in legal action.

 

By confirming your purchase of Digital Products listed by the Company, you agree to the applicable Rights and Reservations policy regarding the use of Digitally Downloaded products. You also acknowledge the proper use of Digital Items and accept responsibility as the Client per these terms.

 

All sales are final underlying digitally downloaded products. Please review the products added to the cart and ensure your purchasing details align to avoid discrepancies or disappointment. The Company does not support buyer mistakes (e.g., purchasing the wrong file). 

 

The Company does not provide installation support beyond the included guidelines followed by your working assets. If you are experiencing technical difficulties with your digitally downloaded products, contact Blake Ferguson Photography for external support and technical assistance.
